Location is Massachusetts. People with schizophrenia have a rate of smoking between 60% and 95% depending on their subtype, way higher than the general population. A housing management company decides to implement a property-wide smoking ban requiring residents to leave the premises and harasses residents when they smoke near the premises. My friend has smoked for years and she is really unable to quit. She has requested a reasonable accommodation that the no-smoking date be extended or that she be allowed to smoke outside on the premises on her balcony. No court is really keen on smoker's rights. However, if a policy or practice has the effect of discriminating against a class of people on the basis of an essential feature of their disability, they must either offer a reasonable accommodation, claim that they cannot make fundamental alterations, claim undue hardship, or change the policy. Does she have a leg to stand on with with a reasonable accommodation request?
HI. I am going to be moving to an awesome place, in which I won the "lottery" for the apartment. The problem is, I am disabled and so is my daughter, 16 (she has chronic migraines and is on independent study because she can't make it at school for even 2 hours a day). I have Section 8. I need a week between apartments so I can move the stuff. I can't even clean my own house- my daughter does it when her migraines aren't very bad. How can they expect me to do everything in 1 day?? I want to request 1 week between apartments so I can get my stuff from point A to point B. Does that sound like a "reasonable accommodation" issue and fair request? Any info on this specific issue, because I am looking online and I can't find anything. Advice welcome!! Thank you!
If anyone is savvy in lease and landlord laws or discrimination against tenants, that would be great if someone could reach out to me. My family and I have had the unfortunate event of experiencing our lease being terminated without basis or grounds (also note: this is HUD housing so the regulations I think might be different) with no stated reason. We have endured blatant discrimination (husband asked for reasonable accommodations when he was on a wheelchair, got denied. Neighbor asked for an assigned spot when she had an issue with my husband parking in what she deemed was her spot--granted for her AND THEN HER FRIEND. Neither of which were on wheelchairs while my husband was. ) Anyway, they refused to do anything about the harassment coming from the neighbors too, racially bullying my husband on a daily basis, making me lose my job by sabotaging our internet (proven by the tech) and numerous other things. If someone has any knowledge on what type of actions to take, how to bring awareness, how to go about this fight legally.
Housing provider will not approve lease takeover / issue new lease under the condition that my doctor verify my disability. This is an apartment community and this is a normal unit, not a special unit for disabled tenants. I have submitted a signed release of resident form, completed and successfully approved rental application, paid security deposit and administrative fees for lease takeover. The manager refuses to sign off and complete the rental process because I requested reasonable accommodation. Housing provider refuses my request for reasonable accommodation because I sent it over email.
Those are the reasons why I said no. She claims that I'm punishing her by doing this. I do have other pictures of her + our family that I'm intending to put up in the house, but my wedding pictures are my favorite and the "main" attraction. My family have mostly stayed out of the drama but my older sister did say she thought I was being petty. AITA?
Once you start your search to find apartments, you can find multiple living options. Either you can choose to stay at the college campus or the usual accommodation. However, it is important to go for the best for a hassle-free residence. Also, opting for UVU Student Housing can be beneficial as here you will be more plugged into the campus and have more opportunities to join fun activities or clubs.
Hello Reddit I'm living with a number of disabilities, my first question is: Are my medical diagnoses, by my PCP and Psych "enough" to "qualify" me as being disabled, or is there an official way this needs to be "proven" for lack of a better term. I am not interested in applying for benefits. What I am looking for is reasonable accommodation at work for PTSD, (also suffer from Panic Attacks, Anxiety, Depression and Chronic Migraines. ) At work I would be looking for things like: a workspace where no one may approach me from behind, I've had a mirror on my monitor in the past; in this space this is not very helpful. Etc Lights: I work under Fluorescent lights. It triggers migraines, and makes them much worse, I wear tinted glasses which is all I can do aside from turning off the light during lunch. I currently rent in NYS: Landlord lives on premises, there are I believe 6 units, we are currently the only occupants. This was formerly or is? A private home with the building converted and units added on.
I was already on half my usual pay because I lost my job at the beginning of lockdown so had to go onto benefits, I didn't need to be spending anymore money. When I asked Mike to buy some food he would say "I'll go to the food bank next week" or "I already bought food" and the food would be a takeaway just for him. What made it worse was that this was all happening during the first lockdown, but he was sneaking out to see friends and his boyfriend and wasn't coming in until 5 or 6 in the morning, usually drunk and wanting food. Eventually his boyfriend was able to let mike stay at his but they recently broke up, and Mike was kicked out. Now everyone is excepting me to take him in again. I've already said I won't do it because I can't afford it and it is technically agaisnt the law (even though my landlord is chill with it because of the current situation) but people keep saying "theres a pandemic and he has no where else to go", and honestly I would but I can't be bothered to babysit him again.
